I had a car crash 2 years ago can I make a claim?

Normally court proceedings must be issued within three years of the date of the accident although occasionally this deadline can be extended, for people younger than 21 years.

If I make a car crash claim who pays the damages?

The claim is normally brought against the Defendant driver although it is the driver`s insurer who defends the claim and pays the damages.

If the driver is untraced or uninsured then the Motor Insurers Bureau (MIB) will isometimes pay compensation to the Claimant.

On occasions the Highways Authority may be to blame for an accident eg by failing to

maintain the road in breach of the Highways Act 1980. Then the claim would be against them.
